By accessing or using VPN Nepal ("vpnnepal.com", "we", "our", or "the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
1Acceptance of Terms
By creating an account, subscribing to any plan, or using VPN Nepal services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
We reserve the right to modify these terms at any time. Continued use of the Service after any modifications constitutes acceptance of the updated terms. We will notify users of significant changes via email or through the Service.
2Service Description
VPN Nepal provides virtual private network services that encrypt your internet connection and route it through our servers. Our Service is designed to enhance privacy and security for legitimate purposes only.
We operate servers in multiple locations and strive to provide reliable, fast connections. However, service availability, speed, and performance may vary based on network conditions, server load, and other factors beyond our control.
3Prohibited Uses
You expressly agree NOT to use VPN Nepal for any of the following purposes:
- Any illegal activity under the laws of Nepal, your jurisdiction, or international law
- Distribution, downloading, or sharing of child sexual abuse material (CSAM)
- Terrorism, terrorist financing, or promotion of violent extremism
- Hacking, unauthorized access to systems, or cyberattacks
- Distribution of malware, viruses, or other harmful software
- Fraud, identity theft, phishing, or financial crimes
- Copyright infringement or intellectual property theft
- Harassment, stalking, threats, or abuse of others
- Spamming, unsolicited bulk messaging, or network abuse
- Any activity that could damage VPN Nepal's reputation or infrastructure
Violation of these prohibitions will result in immediate account termination without refund and may be reported to appropriate authorities.
4Cooperation with Legal Authorities
VPN Nepal is committed to operating within the law and cooperating with legitimate legal requests. While we do not log browsing content or activity history, we may retain limited VPN connection metadata and security audit records as described in our Privacy Policy. We will:
- Comply with valid court orders, warrants, and legal processes from competent authorities in Nepal or through proper international legal cooperation channels
- Provide account information (email, payment details, registration date) when legally required, as outlined in our Privacy Policy
- Terminate accounts of users engaged in illegal activities upon verified legal request
- Cooperate with investigations involving serious crimes including terrorism, child exploitation, and organized crime
Note: Since we do not log browsing history, traffic content, DNS queries, or request bodies, we cannot provide information we do not possess. Our cooperation is limited to account information and the limited connection and security metadata detailed in our Privacy Policy.
5Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- - Implied warranties of merchantability
- - Fitness for a particular purpose
- - Non-infringement
- - Uninterrupted or error-free service
- - Security of transmitted data
- - Accuracy, reliability, or completeness of any content
We do not warrant that the Service will meet your specific requirements, that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.
6Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- No Liability for Damages: VPN Nepal, its directors, employees, partners, agents, suppliers, or affiliates shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
- Service Interruptions: We are not liable for any damages resulting from service interruptions, downtime, connection failures, or inability to access the Service for any reason.
- Third-Party Actions: We are not liable for any damages caused by third parties, including hackers, malicious actors, or government actions that affect your use of the Service.
- User Conduct: We are not liable for any consequences arising from your use or misuse of the Service, including any illegal activities you may conduct.
- Maximum Liability: In no event shall our total liability exceed the amount you paid to VPN Nepal in the twelve (12) months preceding the claim.
7Indemnification
You agree to defend, indemnify, and hold harmless VPN Nepal, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, and settlements including without limitation, reasonable legal and accounting fees resulting from, or alleged to result from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Any illegal activity conducted through your account
8Account Termination
We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms of Service
- Engagement in prohibited activities
- Valid legal requests from authorities
- Non-payment of subscription fees
- Abuse of the Service or its infrastructure
Upon termination for prohibited activities, you forfeit any right to refunds. Termination for other reasons may be eligible for prorated refunds at our discretion.
9Refund Policy
We offer a 30-day money-back guarantee for first-time subscribers. Refund requests must be submitted within 30 days of the initial purchase. Refunds are not available for:
- Accounts terminated for Terms violations
- Subscription renewals (only first purchase eligible)
- Requests made after the 30-day period
10Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved exclusively in the courts of Kathmandu, Nepal. You consent to the personal jurisdiction of such courts and waive any objections to venue.
